I'm pretty sure I made the exact point that Daily Dish pinch-hitter Patrick Appel flags from a Slate piece from Dahlia Lithwick, namely that the government of Fox's 24 doesn't actually condone Jack Bauer's propensity for torture.
The closest thing I could find is this post from the end of 2005, but it only touches on the subject.
